Creditor Garnishment Maximum to be Based on State Minimum Wage in Virginia

Effective July 1, 2021, the maximum amount of disposable earnings subject to garnishment will be based on the state minimum wage, which will be $9.50 per hour in Virginia because of the scheduled increase that begins May 1, 2021. The maximum amount subject to garnishment will be the lesser of: 1.) 25% of disposable income, or 2.) the amount by which disposable income exceeds 40 times the state minimum wage or the federal minim wage (whichever is greater).
